Master’s Thesis at University of Kerbala Discusses Implicit Constitutional Amendments

A master’s thesis at the College of Law at the University of Kerbala, titled “Implicit Constitutional Amendments – A Comparative Study,” was presented by student Israa Hussein Salman.

The study aimed to explain the reasons that lead to the implicit amendment of constitutional texts that are not explicitly stated for amendment within the constitution, in addition to examining the impact of the Federal Supreme Court’s authority on implicit constitutional amendments, as it is the highest judicial authority.

The study concluded that implicit constitutional amendments occur through the decisions of the Federal Supreme Court, which interpret and complement the constitution, filling constitutional legislative gaps overlooked by the constitutional legislator.
