PhD Thesis at University of Kerbala Discusses the Role of Legislative Policy in Reducing the Dissolution of the Marital Bond
A PhD thesis at the College of Law, University of Kerbala, titled “The Role of Legislative Policy in Reducing the Dissolution of the Marital Bond – A Comparative Study,” was presented by student Hussein Kanaan Faleh.
The study aimed to clarify the role of legislative policy in reducing the dissolution of the marital bond, highlighting that successful legislative policy is based on the principle that prevention is better than cure. It emphasized that the Islamic community serves as a model for all nations and should set an example in terms of family and marriage, as well as the issues that might arise, such as divorce and separation.
The study concluded that the fundamental issue leading to the dissolution of marriage stems from individuals’ ignorance of the duties involved in marital life. It further noted that the dissolution of the marriage contract is a license and an exception to the rule. In this regard, comparative legislation often addresses the reasons leading to the removal of this license. However, the Iraqi legislator has not paid sufficient attention to this matter in the Iraqi Personal Status Law.
