A Master’s Thesis at the University of Kerbala Discusses the Legal System of International Trademarks

A Master’s thesis at the Faculty of Law at the University of Kerbala, titled “The Legal System of International Trademarks – A Comparative Study,” was discussed by Marwan Ghaleb Obaid.

The study aimed to clarify the legal aspects of trademarks, focusing on the protection and registration of international trademarks, and examining the formal and substantive requirements to address legislative shortcomings in the Iraqi trademark law by comparing it with other legal systems.

The study concluded that the Iraqi legislator did not define international trademarks in the Trademark and Commercial Data Law, but it provides protection even if the trademark is not registered in Iraq, provided that the country of origin is a member of the Paris Union, the World Trade Organization, or any agreement Iraq is part of, or is treated similarly to Iraq.
